Primate: Terms & Conditions

Joining Primate

  • You must have a Mighty Ape (New Zealand) account to become a Primate member. It’s free to create a Mighty Ape account. 
  • If you have an account and you are logged in, you can join Primate from the Checkout when making a purchase, or from the Primate page.
  • We reserve the right to accept or reject your Primate membership application at our sole discretion.
  • You will receive an email from Mighty Ape confirming your Primate membership has been activated.

Free Trial Period

  • Free trials are only available on accounts that have not previously had a Primate membership. If your Primate membership has lapsed, or you previously decided not to renew a Primate membership, you will not be eligible for a free trial.
  • There is a maximum of one free trial per customer. You may not create another Mighty Ape account in order to take advantage of the free trial more than once. We reserve the right to accept or reject your Primate membership application and free trial at our sole discretion.
  • If you start a free trial, you will be required to provide a credit or debit card to be used should you continue your membership after the free trial period.
  • You may cancel your membership at any time during the free trial period. You can cancel your membership from our Website My Account.
  • If you cancel your membership during your 2 week free trial period, your membership will not renew and you will incur no charge. Your Primate benefits will end immediately once the trial has been cancelled.
  • If you do not cancel your membership before the free trial period has ended, your membership will be automatically renewed for the Membership Period you selected when you joined Primate and you will be charged the full membership fee for that Membership Period. You will automatically be added to the 3 month subscription and if you would like to increase to a 12 month subscription you need to update this via My Account. We will endeavour to notify you of this automatic rollover of your subscription occurring prior to the end of your free trial period.

Membership Periods & Fees

  • The fee for each Membership Period is as follows:
    • $60 for a Yearly Primate Membership
    • $24 for a Quarterly Primate Membership
  • The Membership Fee will be charged in advance of each Membership Period and is non-refundable.
  • If your Primate membership includes a Free Trial, your Membership Period will begin at the end of the Free Trial period, and your Membership Fee will be charged at the end of your Free Trial period.
  • Payment of the Membership Fee must be with a credit card or debit card.
  • You can change your Membership Period and payment methods at any time from My Account. If you select a different Membership Period (e.g. Quarterly to Yearly), the new Membership Period will begin at the end of your current Membership Period.

Charges for Membership Fees

  • You will be charged a Membership Fee once you Join Primate and Mighty Ape sends you an email confirming your Primate membership (or, if you have started a Free Trial, at the conclusion of the Free Trial period); and
  • In the case of a renewal of an existing Primate membership, one day before the commencement of the new Membership Period. If your credit or debit card is declined, you will be required to arrange funds to be available on that card, or select a different card, before the end of your current Membership Period for your Primate membership to renew and continue without interruption.

Term and Renewal

  • Your Primate membership starts on the date that you registered for Primate and is valid for the duration of your current Membership Period.
  • If you have registered for a Free Trial, your first Membership Period will begin at the end of your Free Trial period.
  • Your Primate membership will automatically renew at the end of each Membership Period for an additional Membership Period, unless you or Mighty Ape cancel your membership prior to the end of the relevant Membership Period. You can choose a different Membership Period or cancel your membership at any time from My Account.
  • Mighty Ape will notify you by email before the start of your next Membership Period and present you with the opportunity to change your Membership Period or cancel your Primate membership.
  • Membership Periods always renew on the same day of the month. For example, if the “Quarterly” option was first started on 15 July, the second Membership Period would start on 15 October and the third Membership Period on 15 January. To account for the variable length of months, Membership Periods originally started on the 29th, 30th, or 31st of any month would be started on the 1st of each subsequent month, resulting in those customers receiving a few additional days for free during their first Membership Periods.
  • Unless you notify us before a charge that you wish to cancel your Primate membership, your membership will automatically renew for another Membership Period and you will be charged the appropriate Membership Fee using the payment method we have on record for you. You can notify us by using Live Chat, sending a message to Contact Us or canceling your membership in My Account.

Canceling your membership

  • You may cancel your Primate membership at any time.
  • Primate memberships are billed in advance of each Membership Period and fees are non-refundable.
  • Mighty Ape may at its sole discretion choose to refund your Membership Fee for your current Membership Period if it can be determined that you have not utilised the benefits of Primate membership during that Membership Period.
  • When canceling your membership you will continue to enjoy the benefits of Primate until the end of your current Membership Period. Any orders placed before your Primate membership ends (e.g. free shipping, shipping discounts, or discounts on products) will also continue to receive the benefits of your membership.
  • Mighty Ape may cancel your Primate membership for any reason by providing 14 days’ notice. If Mighty Ape cancels your membership without your agreement a prorated refund of your Primate membership fee based on the time remaining on your current membership period will be provided.

Benefits of Primate membership

  • Primate members are eligible for Free Standard Delivery within New Zealand on all eligible items. Eligibility is displayed as a badge on the product page. 
  • Primate members are eligible for a discount on heavy and bulky item delivery. Discounts on heavy and bulky items are displayed in the checkout. 
  • A minimum order value of $10 applies for all Mighty Ape orders containing physical products and this minimum order value also applies to Primates.
  • Primate members can upgrade to Rural Delivery and Signature Required Delivery at no additional cost. 
  • Additional charges still apply for some delivery services including Jungle Express delivery and Evening Express delivery, although Primate members receive a discount on these services. 
  • Primate members receive exclusive discounts on selected products known as Primate Member Deals. Primate Member Deals are clearly labeled on the product page and can also be accessed from the Primate Deals page.
  • Primate members enjoy early access to Sales and Promotions at Mighty Ape’s sole discretion. 
  • Emails sent to Mighty Ape from Primate members are treated as high priority by our Customer Support and receive a faster response.
  • Primate Members receive a greater discount on eligible products and services. Please see our website for further information.

Miscellaneous 

  • Primate members are not permitted to purchase products for the purpose of resale, rental, or to ship directly to their customers or potential customers using Primate benefits.

Amendments to these Terms

  • Mighty Ape may, in its sole discretion, amend these Terms at any time by posting the amended Terms on the Mighty Ape Website. We will notify you of any material amendments to the Terms directly through the email address linked to your Mighty Ape account. Unless stated otherwise, all amended Terms will be effective immediately upon being posted online.
  • Any amendments to the Terms will not affect your rights to cancel your Primate membership. Your continued Primate membership and use of Primate benefits after any amendments to the Terms will constitute your acceptance of the amendments. If you do not agree to any amendments to the Terms, you should cancel your membership and a prorated refund of your Primate membership fee based on the time remaining on your current membership period will be provided.
